Open Burning Information

In Massachusetts, open burning is generally allowed Jan 15 – May 1 between the hours of 10 am – 4 pm for brush/forestry debris, with permits from the local Fire Dept. Local rules override general state laws, so always check with your town. State fire wardens determine each day whether conditions are safe for open burning. Weather and air quality can change rapidly, especially in the spring, and fire departments can rescind permits when that happens.

  • Season: Jan 15 – May 1.
  • Time: 10:00 AM to 4:00 PM
  • Permit: Required from your local Fire Department.  Call the Non-Emergency FD number for specific permitting process.
  • Location: 75 feet from dwellings; on land near where debris was generated.
  • Materials Allowed: Brush, garden waste, tree trimmings only
  • Materials Banned: Leaves, hay, grass, stumps, trash, construction debris, building materials, commercial clearing debris.
  • Conditions: Must have water source (garden hose) available, constant attendance (no burning on high wind/danger or during excessively dry conditions). 
  • Where Burning is Banned/Restricted:
    Cities like Boston, Worcester, Lowell, Springfield, etc., generally prohibit open burning.

    Rules vary significantly; some towns (like Lowell) forbid it completely, while others (like Amherst, Hanover) have strict local rules. Contact your local Fire Department before any burning.
